Terms and Conditions of Booking, including Cancellation Policy
Please read the following summation of Ocean Adventures Terms and Conditions. Following this summation is a link to see the 3 sets of forms that each participant is required to read, complete, sign and submit to the Company.
Once these forms are completed, signed and submitted plus the deposit is paid, the booking is considered confirmed.
Clients must arrive at the port of departure at the time and date specified in the booking package, (the "Departure Date"). The Company will take reasonable steps to assist late arrival clients in transiting to the Vessel, however, all costs for such transit shall be solely on account of such late arrivals and the Company does not represent or warrant that such a transit for late arrival is available or possible. The Company shall not refund any portion of the trip price for such late arrivals.
PAYMENT SCHEDULE including Requirements for Trip Confirmation
A reservation for our Scheduled Trips will be confirmed upon receipt of the completed and signed Registration Form with Terms and Conditions of Booking, and a signed Release, Waiver, and Indemnity Agreement, (one for each client), a completed and signed Medical Form, and a deposit of $1500 Canadian per person, per trip.
A deposit of 50% of the cost of the Custom Trip (before tax) is necessary to reserve the trip.
The balance owing is due in our office 90 days before the Departure Date.
If you wish to cancel your booking, the cancellation must be made to the Company in writing, and the following schedule applies to refunds:
CANCELLATIONS BY THE COMPANY
- If the written notice of cancellation is received by the Company more than 120 days before the Departure Date: full refund less $300 administration fee, per person;
- If the written notice of cancellation is received by the Company 90 - 120 days before the Departure Date: no refund, but transferred to another available trip;
- If the written notice of cancellation is received by the Company, less than 90 days before the Departure Date: no refund but the client may transfer the trip to a suitable client if the replacement client is accepted by the Company, the decision whether or not to accept the replacement client being at the sole discretion of the Company.
If the Company does not receive the balance of the trip price 90 days before the Departure Date, the Company reserves the right to treat the booking as cancelled and to retain the full deposit. The Company reserves the right to cancel any booking if through circumstances beyond its control, it is impossible to provide the trip, in which case an alternative may be offered or any sums received will be returned in full, but the client shall have no further claim against the Company. Deposits may not be carried forward to future seasons or packages.
TRAVEL INSURANCE REQUIRED - INSURANCE NOT INCLUDED
All clients are strongly recommended to have travel and trip cancellation insurance at the time of booking. No insurance is provided in the trip price. Clients are advised to read their own travel and trip cancellation insurance policy carefully, and review the policy wording and other insurance requirements. Insurance must be purchased when your trip is confirmed and my be obtained through any travel agent or insurance broker.
The Company highly recommends that all clients obtain extended medical insurance including emergency evacuation insurance. The trips are in very remote areas. Access to emergency and medical facilities is very time consuming, difficult, and costly. The client will be responsible for paying the full expenses of any emergency evacuation.
RESPONSIBILITY OF THE COMPANY
The Company shall not be liable for any loss, damage, injury or delay, including travel delays due to bad weather, industrial action or any other reason beyond the Company's control incurred by the client before the start of, or during the trip.
The Company cannot accept responsibility for delays caused by factors beyond its reasonable control and reserves the right to vary or restrict a trip. In such an event, every effort will be made to re-route the Vessel and alert the client to any such alterations but the client shall have no claim upon the Company.
The client shall have no claim upon the Company as a result of any breakdown or failure of the Vessel's engine or other equipment or any delays caused by repairs to the Vessel. If a trip is curtailed, amounts proportional to the un-expired portion of a trip will be refunded, but no further claim can be made.
The Company reserves the right to cancel any trip or portion thereof, at any time, on refund of the appropriate amount paid by any client, or to change any trip itinerary due to circumstances beyond its reasonable control without any liability to any client.
HEALTH AND FITNESS
The adventure travel activities offered by the Company can be physically
demanding and require participants to be in good physical shape. Some of the adventures travel activities take place in challenging terrain. If you are in doubt as to your physical condition or abilities, please check with us before booking a trip. No refunds will be made to clients who through lack of physical conditioning are unable to participate in activities.
As a condition of booking, each participant will be required to complete, sign, and submit a Medical Form.
